Are Court Records Public in Orange County?
California law favors public access to court records. California Rules of Court, Rule 2.400(a) grants the right to inspect documents in a court file at the clerk’s office. Under Rule 2.550(a), unless a statute or court order designates a record as confidential, court documents are treated as public records.
Publicly Accessible Records
Most filings across civil, criminal, family law, probate, and small-claims cases are open to inspection. This includes complaints, answers, motions, court orders, judgments, minute entries, and admitted exhibits. Docket information—party names, case numbers, hearing dates, and disposition—is available free of charge through the online case-access system.
Records That Are Confidential or Restricted
Several categories are shielded from public view by statute or court rule:
- Juvenile dependency and delinquency proceedings

Sealing Procedures
A party seeking to seal a court record must file a motion demonstrating that an overriding interest exists that overcomes the public right of access, that the proposed sealing is narrowly tailored, and that no less restrictive means are available. Fee Waivers
Individuals who cannot afford copy or filing fees may apply for a fee waiver. If the court grants a waiver, the applicant is excused from paying filing fees, record-search fees, and copy fees. The court may later order reimbursement from any judgment recovered or from a support order in family law cases.
Orange County Criminal Court Records

Reports cost $0.15 per page. Domestic-violence reports are provided at no cost to the victim under Family Code § 6228. Juvenile reports generally require a petition to the Presiding Judge of the Juvenile Court.

Marriage Records
Marriage licenses are issued by the Orange County Clerk-Recorder, not by the Superior Court. A public marriage license costs $61. Certified copies of marriage certificates cost $17 and may be requested in person (after completing the online application) or by mail using the Vital Records Request Form (signed and notarized). Divorce Records
Divorce decrees and related orders are part of the Superior Court case file and are accessed through the Family Law Case Access portal or by submitting Form L-3009 to the Lamoreaux Justice Center.
Birth and Death Certificates
Birth and death records are maintained by the Orange County Clerk-Recorder. Only authorized individuals—such as the registrant, a parent, a legal representative, or an immediate family member—may receive a certified copy. Those who do not qualify may request an informational copy stamped “INFORMATIONAL, NOT A VALID DOCUMENT TO ESTABLISH IDENTITY”. Fees are $34 per certified birth certificate and $26 per certified death certificate. The application and ordering process is the same as for marriage records: complete the online vital records application for in-person pickup, or mail the signed and notarized request form with payment.
Orange County Probate Court Records
Probate and mental-health matters in Orange County are handled by the Superior Court’s Probate/Mental Health Unit, which operates out of the Costa Mesa Justice Complex at 3390 Harbor Blvd., Costa Mesa, CA 92626. The Probate division oversees decedents’ estates, wills and trusts, conservatorships, guardianships, minor’s compromises, and elder and dependent adult abuse cases.
