Are Court Records Public in Lassen County?
Under California Rules of Court, Rule 2.550(a), all court records are presumed to be open to public inspection unless they are made confidential by law or sealed by a court order. This presumption of openness applies across all case types handled by the Lassen County Superior Court.
Despite this broad public access presumption, several categories of records are restricted or entirely confidential:
- Juvenile court records: All juvenile court files are confidential. Only the minor, parents or legal guardians, and attorneys of record may obtain copies in person at the Hall of Justice with photo identification. Records will not be mailed.
- Sealed records: A judge may issue an order sealing specific case files or documents. Once sealed, the public is prevented from viewing those materials without a separate court order.
- Attorney-client communications: These are protected from disclosure as privileged materials.
- Preliminary judicial drafts: Notes, memoranda, and draft documents created by judicial officers are not subject to public inspection.
- Expunged records: Court documents expunged by judicial action or statute are withheld from public access.
- Cases filed before 1994: These may not appear in the online portal and require in-person or written requests to the clerk.
The court does not confirm personal information about a party — including date of birth, Social Security number digits, address, or driver’s license number — by phone or email unless there is a legitimate court business need. Individuals seeking personal identifying details must visit the courthouse in person or submit a formal request form. Persons who willfully remove, alter, or destroy court records are subject to penalties under California Government Code §§ 6200 and 6201, which include imprisonment, fines, or both.
